Negotiable Instruments Act, 1881–Secs. 138 & 142–Code of Criminal Procedure, 1973–Sec. 482–Complaint by the Company–It was filed in the name of the Company i.e. the payee through ‘SK’ the general manager (accounting)–Authorisation in his favour to institute the criminal proceeding including the proceedings under the provisions of N.I. Act–Notice was issued by ‘SK’ on behalf of the Company and he was the person who had the knowledge of the transaction and was the witness to it–Complaint was supported with the affidavit containing the averments of authorization and knowledge on part of ‘SK’–Held, High Court was not justified in quashing the complaint on the above grounds.
