Penal Code, 1860–Secs. 304 Pt. I & II–Distinction between both provisions–In an offence u/s. 304 Pt. II, prosecution is to prove the death of a person in question and such death should be caused by the act of the accused khowing that such act is likely to cause death–Whereas for the offence punishable u/s. 304 Pt. I, both khowledge and intention are necessary.
