Evidence Act, 1872–Sec. 10–Applicability of provision–For a case to fall u/s. 10 of the Evidence Act, there has to be a prima facie case of criminal conspiracy–The disclosure statement of any fact that is brought to the notice of authorities should have been made during the pendency of the conspiracy–Statement made by one of accused, after the event taken place, cannot be used u/s. 10.
