Prevention of Corruption Act, 1988–Secs. 7 & 13(1)(d) r/w. 13(2)–Conviction–Reversed of the High Court–Justification–High Court gave undue importance to the minor discrepancies in the evidence of witnesses– PW 1 clearly stated in regard to demand and acceptance of the bribe amount–Conclusion of High Court that there is no material to show that accused put the notes in his pocket, is contrary to evidence– Version of other witnesses was also found supporting the case of the prosecution–High Court also gave undue weightage to some confusions about the names of PW 2 & 4– Trial Court properly appreciated the evidence–Findings recorded by the Trial Court are liable to be restored.
