Criminal Trial–Circumstance of causing burn injuries–Recovery of a kerosene tin, a match box and as many three burnt matchsticks from the place of the incident–The presence of these articles, particularly three used matchsticks, unmistakably suggests that more than one attempts were made to ignite the fire–This circumstance assumes importance, for if the deceased was allegedly overpowered and forcibly set ablazed by the accused, the natural human conduct would not reasonably permit repeated attempts at striking matches without resistence or an opportunity for the victim to raise alarm–The recovery probablises the defence version that the deceased had sufficient time and opportunity, and the act was not sudden or instantaneous.
