Rajasthan Imposition of Ceiling on Agricultural Holdings Act, 1973–Sec. 15–Re-opening of the ceiling case after the prescribed limitation of three years of the publication of the final statement u/s. 13–Justification–Order for re-opening was passed on the ground that the decisions of the Authorized Officer dated 20.01.1976 and the BOR dated 14.07.1976 were against the provisions of the Act as also against the State’s interest–Writ petition against–Dismissal of –Justification–There were specific grounds pleaded before the Writ Court which refer the plea of limitation in exercising the powers u/s. 15(1) of the Act–Writ Court committed error of records in refusing to take note of the plea of limitation raised on behalf of the appellants and proceeded to examine the matter on merits which was not permissible in the face of the bar u/s. 15(1) of the Act –Order of State Govt. for re-opening the final statement order was without jurisdiction and palpably wrong–Special appeals deserve to be allowed.
