Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989–Sec. 3(2)(v)–Penal Code, 1860–Sec. 458–Cognizance has been taken against the petitioners for the offence u/s. 458 and the punishment may be extended up to the imprisonment of fourteen years with fine–Therefore, the provisions of Sec. 3(2)(v) are not applicable–Charge lacks the necessary foundation and cannot be sustained.
