Code of Civil Procedure, 1908–Order 39, Rules 1 & 2–Rejection of application–Appreciation of–Appellants failed to prove that he was in possession of disputed land–In earlier suit, compromise was entered by the parties and decree there upon was passed which was upheld by Board of Revenue–Appellant remained silent for 29 years–Further, in another suit, he failed to prove that he was the adopted son of R–Respondents proved the fact that they purchased the land in question through regd. sale deed and mutation has been opened in their favour–Held, plaintiff failed to establish all the three elements for granting temporary injunction and application was rightly dismissed.
