Specific Relief Act, 1963–Sec. 28–Application under–Dismissal of–Ground of petitioner-judgment debtor that the amount of Rs. 20,000/- was to be deposited by the decree-holder within a period of two months of judgment–The said judgment nowhere direct plaintiff to pay the amount in any specific time-frame–Further, nothing is available on record to show that the judgment-debtor ever demanded the said amount from the plaintiff–Furthermore, in the averments of execution petition, it has been stated that the amount was offered to the defendant but he refused to accept it–Held, deposit of amount cannot be termed to be illegal on any ground–Interference declined.
