Code of Criminal Procedure, 1973–Sec. 451/457 [Corresponding Secs. 497/503 of BNSS, 2023]–Rajasthan Minor Minerals Concession Rules, 2017–Rule 54/60–Penal Code, 1860–Sec. 379–Relese of vehicle–Under the mining law, the State Authorities have the powers for initiating the confiscation proceedings in relation to the vehicle seized for violation of the mining laws–Vehicle can be released on supurdginama only after the payment of penalty and compounding fees–However, a Criminal Court is not supposed to keep a vehicle detained until the confiscation proceedings are commenced and concluded by the Mining Department–Petitioner is given liberty to approach the competent Criminal Court.
