Code of Civil Procedure, 1908–Order 39, Rules 1 & 2–Application for granting the temporary injunction–Dismissed–Appreciation of–Property in question was given to the non-applicant for government official purpose–As per covenant, it was not given on licence–Further, no specific purpose was assigned in the covenant and no time limit was mentioned in it regarding giving the possession after shifting the govt. offices–Contention of non-applicants that they are running govt. offices and they would not create third party rights/interest–Trial Court rightly exercised the discretion in dismissing the application.
