Narcotic Drugs & Psychotropic Substances Act, 1985–Secs. 8/21(c)–Conviction–Recovery of contraband from the pillion rider of motorcycle– Appellant was driving the motorcycle–Plea of not having the consious possession over the contraband–Vehicle was not a public vehicle and appellant was to explain that how he travelled with the pillion rider–Simply saying that he was driving motor cycle without offering an explanation is illogical–Recovery proceedings were held at the spot and weighting scale and weight & measures were arranged from the near area which cannot be as standard as available in FSL–Few variances in weight is not a ground for throwing the rosecution case–Held, conviction was justified.
