Practice & Procedure–Code of Criminal Procedure, 1973–Sec. 156(3)–Contempt of Court–Respondent-police personal assaulted the appellant when he went to the police station to serve a notice by dasti tamil–Writ petition filed by the appellant with seeking the inquiry by CBI–High Court dismissed the petition with view that no criminal complaint was registered for the alleged offense–Further, appellant was directed to file the complaint u/s. 156(3)–Appeal before Supreme Court–Direction of Supreme Court to inquire the matter–Report of Addl. Sessions Judge showing that the appellant was subjected to brutality in a police station and act/omission of various police personals
established in order to serve the dasti tamil issued by Supreme Court–Held, this act amounts to the misconduct of serious nature–Direction of disciplinary proceedings issued and the appellant is given liberty to file the criminal complaint u/s. 200 on the basis of conclusion report produced by Addl. Sessions Judge.
