Insecticides Act, 1968–Sec. 29(1)(a)–Criminal proceedings–Sustainability–Sample of seed was found not as per prescribed standard–No allegation upto effect that the petitioner-directors were responsible for the conduct of business of company–Quality control officer was appointed by the company–Further, the Insecticide Inspector failed to send the report of analyst to the manufacturer and they deprived from their valuable right of examination of sample from Central Insecticide Laboratory–Court also did not send the samples inspite of application–Held, impugned order of taking cognizance qua the petitioners is liable to be quashed.
