Code of Civil Procedure, 1908–Order 22, Rules 4 & 5–High Court allowed the application for substitution of LRs. without deciding the question as to whether K was the legal representative of deceased-defendant or not–Whether proper ?–Held, no–Matter ought to be remanded back to decide this issue as the inquiry was necessary for deciding this issue which could be done only by the trial Court.
