Rajasthan Tenancy Act, 1955–Sec. 251-A–Order of allowing of the application–Sustainability–It is uncontested that as per respondent, fifteen fit passage was already existed–There was neither a prayer for opening a new way nor for widening the existing way yet the application u/s. 251-A was entertained–If there was any grievance with regard to disturbance and blockage being created in the existing way, the remedy would have been u/s. 251 before the Tehsildar and not before the SDO–Impunged orders are liable to be set aside.
