Penal Code, 1860–Secs. 302/201–Conviction–Appreciation of–Circumstantial evidence–Dead body was recovered from the place which was disclosed by the appellant–It was exhumed and identified by the superimposition test and DNA examination–Car of deceased was recovered from PW 16 at the instance of appellant–Prosecution proved that the stolen car was sold by appellant to PW 16–Further, the engine and gear box were sold by him to PW 17–Plea of appellant that the prosecution failed to prove the homicidal death of deceased, cannot be accepted as it was not possible for the prosecution, however, the circumstances establish and prove that the deceased was killed and his car was stolen–Conviction sustained.
