Motor Vehicles Act, 1988–Sec. 147–Insurance Company was exonerated from the liability with observation that the place of accident was not a public place–Deceased was a dumper driver deployed at Hindusthan Zink Ltd. and was on duty on the said date–JCB deployed by HIndusthan Zink Ltd. entered into the premises for excavation work and caused the accident–The access to the JCB was provided by Hindusthan Zink Ltd. for a specific purpose–It can be safely observed that the spot of accident was a public place–Appeal of owner deserves to be allowed.
