Penal Code, 1860–Sec. 326 [Corresponding Sec. 118(2) of BNS, 2023] –Conviction–Reduction of the sentence–Incident occurred in the year 1994 due to some verbal altercation between the appellant and injured–Appellant has suffered a protracted trial and appeal proceedings for a period of more than 30 years–He has remained in jail for one month and five days–He is now of advanced age of 68 years and is infirm–Taking to the totality of facts and mitigating circumstances of the case, the gravity and nature of offence, age of accused, the injury caused, and custody undergone by him, the sentence is reduced up to the period of already undergone.
