Penal Code, 1860–Sec. 306 [Corresponding Sec. 108 of BNS, 2023]–Conviction–Sustainability–Death of the deceased has been alleged due to mental harassment arising out of marital discord and the purported illicit relationship of appellant G with a third party–Deceased had alternative co-urses of action available, including seeking protection, approaching authorities for redressal or severing matrimonial ties–There is no material to suggest that the appellant engaged in any overt-act, instigation or coercion that rendered suicide the only or inevitable course–Conviction cannot be sustained.
