Bharatiya Nagarik Suraksha Sanhita, 2023–Sec. 175(3) [Corresponding Sec. 156(3) of Cr.P.C.]–Scope–Power under the Section should not be misused to carry out investigation in frivolous complaints–The Magistrate may also conduct his own inquiry before arriving at a just decision to prevent misuse of police powers–The provisions aim to ensure effective and fair investigation of cognizable offences while balancing the need for judicial vigilance.
