Penal Code, 1860–Secs. 498-A & 302–Conviction Appreciation of–No room of doubt so as to disbelieve the dying declaration–Appellant-husband was present at home at the time of incident–Parcha bayan and dying declaration revealing that the deceased sustained the burn injuries after the kerosene was poured and fire was ignited by appellant–It is not the case of tutoring the deceased by her close family members–Further, the deceased stated that brother-in-law tried to douse the fire–Dying declaration is worth of credence–Conviction sustained.
