Bharatiya Nagarik Suraksha Sanhita, 2023–Sec. 230 [Corresponding Sec. 207 of Cr.P.C., 1973]–The supply of charge-sheet alongwith CD was effected through the Investigating Agency without judicial verification or grant of reasonable time to the accused to ascertain completeness–More importantly, where the prosecution case substantially rests upon the electronic evidence, compliance with Sec. 230 assumes heightened significance–The furnishing of incomplete or legally unrecognized copies stikes at the very root of the accused’s right to effectively invoke the remedy of discharge u/s. 250 B.N.S.S.
