Motor Vehicles Act, 1988–Sec. 149(2)(b)(ii)–Licence of driver expired on 19.01.2015 and the accident occurred on 30.04.2015–Driver of vehicle was not holding the effective driving licence on the day of the accident–It was a fundamental breach of policy conditions–When the application for renewal of licence is made after the thirty days of its expiry, the same gets renewed from the date of its renewal and not from the date of its expiry–DTO report clearly mentions that the licence in question was not valid on the day of accident–Tribunal rightly granted the liberty to Insurance Company for recovery of compensation amount from the appellant-owner.
