Rajasthan Rent Control Act, 2001–Sec. 9(a)–Eviction was sought on the basis of default in payment–Denial–Appreciation of–Notice was issued with stating the due amount of rent for four months, however, the amount due was not shown in it–Further, the actual period was also not shown in it–Held, notice was not in conformity with Sec. 9(a)–Further, the record of case revealing that earlier, the petitioner-land-lord denied to accept the amount of rent tendered by tenant–Furthermore, tenant deposited the amount in the first instance after service of notice–Held, default could not be proved and petition was rightly dismissed.
