Code of Civil Procedure, 1908–Order 9, Rule 13–Prayer to set aside the ex parte decree–Rejected–Petitioners were impleaded as the parties of the suit as the bonafide purchasers–Their submission that they were never served the summon of the suit–Acceptability–Record of the case reveals that they were served properly–Appellants were also the party in the revenue suit and even preferred their respective counter-claim in those proceedings–It cannot be presumed that they were not aware about the preliminary and final decree of partition–Further, the reason assigned for the delay of two years is not plausible–Held, no ground is made out for interference.
