Code of Civil Procedure, 1908–Order 23, Rules 3 & 3A & Sec. 96–Rajasthan Tenancy Act, 1955–Secs. 88, 89, 53 & 183–Revenue suit was decreed in the second appeal on the basis of compromise–However, the 16 bigha land provided in the share of the plaintiff was of no consequence in relation to the suit filed by her because the ownership of 16 bigha land had already ordered in favour of her husband by the order dated 27.07.1982–Plaintiff did not touch the issue of the earlier agreement of sale and subsequent power of attorney and the regd. sale deeds in favour of petitioners through the suit–Compromise decree cannot be interfered at the instance of the present petitioners as it is not touching their rights–Challenge to the compromise decree is not maintainable through the present petition.
