Jaipur Development Authority Act, 1982–Sec. 72–Complaint and criminal proceedings–Sustainability–It has come out that the encroachment has been made by the NIMS University–Only officers of the University could be held liable for encroachment and not the person having concern with sponsoring body–Complainant against the accused-petitioner without implicating the NIMS University and also the Indian Medical Trust as a party is not maintainable–Further, the notice was issued against a dead person and the complaint based on such notice is not sustainable–Furthermore, the respondent-JDA has not placed any material on record to show that the impugned complaint was filed after seeking prior approval from the Authorities–Complaint and consequential proceedings are liable to be quashed and set aside.
