Code of Civil Procedure, 1908–Order 14, Rule 5–Issue as regard to validity and genuineness of the Will–Ground of the petitioner that the burden to prove was to be imposed on the respondent-defendant–Acceptability–Trial Court observed that the initial onus to prove the validity of the Will lies on the propounder of the Will, and once this initial burden is discharged, the burden to prove that such Will is forged and fabricated lies upon the person who challenges the validity of Will–Contention of the petitioner that the Trial Court has not dealt with the proposed issue nos. 1 & 2 is not sustainable–Further, the proposed issue no. 3 is covered under the issue no. 4–Held, no case is made out for interference.
