Code of Civil Procedure, 1908–Order 7, Rule 11–Companies Act, 2013–Sec. 430–Suit for determination of shares in the company with the allegation that the plaintiff was removed from the post of director with ill motive–As per Sec. 430 of the Act, Civil Court has no jurisdiction to try the suit–Suit filed by the plaintiff was barred by law and defendant’s application under Order 7, Rule 11 deserves to be allowed.
