Code of Civil Procedure, 1908–Sec. 100–Scope–While answering the substantial question of law, High Court discussed the evidence of case–Whether it can be said that the High Court re-appreciated the evidence of record ?–Held, no–Many times whle deciding/answering the substantial question of law, the evidence on record is required to be discussed and/or considered–But, by that itself, it cannot be said that it is re-appreciation of the entire evidence on record.
