Rajasthan Public Trust Act, 1959–Election of Charitable Trust–Set aside with the direction for conducting the fresh election as the appointment of Election Officer was without power and authority–Tenure of petitioner-president came to end on 11.10.2020 and he sought directions from the Sanrakshan Mandal in respect to the elections–However, without waiting for the directions, he appointed the Election Officer–After that, the Sanrakshan Mandal quashed the order by invoking its powers under Section 10(2) & 10(3)(3) of the Constitution of Trust–Despite this order, petitioner proceeded to conduct the election–Held, election was rightly set aside by Assistant Commissioner as it goes against the very ethos of the Constitution of the Trust.
