Penal Code, 1860–Secs. 397/149–Charge framed for the offence–Trial Court has acted in a mechanical manner while framing the charge and has not at all made any endeavour to spell out the reasons for framing the charge u/s. 397/149 against the petitioner–Charge-sheet has been filed only for the offence u/ss. 395, 325, 427, 341 & 323–Impugned order quashed and set aside and matter remanded back for passing a fresh order.
