Negotiable Instruments Act,1881–Secs. 138 & 147–While accepting the compromise, appellate Court directed to deposit the 15 % of the cheque amount with the District Legal Services Authority–Petitioner is unemployed and he managed the cheque amount somehow–Held, requirement of deposit of penalty can be waived–Appellate Court is directed to decide the appeal in view of above observations.
