Indian Succession Act, 1925–Secs. 372 & 8–Scope–Even if no application is made by any non-applicant or objector, and such non-applicant/objector is found to be equally entitled to the issuance of a succession certificate, such non-applicant/objector’s claim may be considered akin to that of an applicant for the purpose of granting a succession certificate in their favour–In the instant case, the applicant is class I legal heir of the deceased, and is entitled to 1/3 share in the movable property of the deceased–Order modified accordingly.
