Indian Succession Act, 1925–Sec. 372–Code of Civil Procedure, 1908–Order 7, Rule 11–Proceedings for succession certificate–Prayer for rejection–Refused–Proceedings of probate and for succession certificate are different proceedings and operates in different circumstances–In a probate proceeding, genuineness of the ‘Will’ is examined and after finding that the ‘Will’ was genuine one, the last ‘Will’ of the testator is given priority leaving aside the normal rule of succession–In a succession certificate proceeding, the natural successor gets certificate from the competent authority/court to claim property left by their predecessor–It was not a case for rejection of the succession certificate proceedings–Application under Order 7, Rule 11 was rightly rejected.
