Narcotic Drugs & Psychotropic Substances Act, 1985–Sec. 50–Nature and scope of provisions-
(i) Suspect has a right to be informed by the duly authorized officer about the existence of his right and that if he so requires, he shall be searched before a Gazetted Officer or a Magistrate.
(ii) Failure to inform the suspect would cause prejudice to suspect It would not vitiate the trial but would render the recovery of the illicit article and would vitiate the conviction and sentence.
