Penal Code, 1860–Sec. 494–Establishment of offence–Way of–In the offence of bigamy–
(1) the factum of the second marriage has to be established and proved like any other fact with acceptable legal evidence,
(2) it has to be proved that the said marriage was solemnized in the due form as per custom and ceremonies prevailed in the said community, and
(3) it has to be proved that both i.e., the first marriage and the second marriage are valid marriages solemnized as per the ceremonies prevailing in the community.
