Motor Vehicles Act, 1988–Sec. 164 (As amended)–Whether the Tribunal was justified in deciding the claim petition filed u/s. 163A (as it then existed) in terms of amended provisions of Sec. 164 on the premise that the amended provisions had come into effect from 01.09.2019 ?–Held, no–It is clear that the amended provisions of Secs. 145 to 164 came into effect by S.O. No. 859(E) dated 25.02.2022–Therefore, the findings recorded by the Tribunal to the effect that the matter would be governed by Sec. 164, are liable to be set aside–However, the Second Schedule of Act has been amended w.e.f. 01.01.2019 and amount of Rs. five lakh has been substituted in the death case–Amount of Rs. five lakh, awarded by Tribunal does not require any modification.
