Code of Civil Procedure, 1908–Order 9, Rule 7–Ex-parte judgment and decree were passed without following the mandate of law–Ex-parte judgment was passed without fixing the date for the ex-parte hearing, as such, taking away the rights of defendant-appellant to show reasons for non-apearance as permitted under Order 9, Rule 7–Impugned judgment and decree set aside and matter remitted back to Trial Court for deciding afresh.
