Penal Code, 1860–Sec. 376 [Corresponding Sec. 64 of BNS, 2023]–Criminal proceedings– High Court declined to quash–Case of complainant that the appellant refused to marry with her–Terming this to be rape on pretext of marriage, the complainant filed the subject FIR–Appellant-accused and the complainant had been collegues for the past five years–Appellant- accused had initiated legal process/administrative process against the complainant much prior to the subject FIR being lodged–FIR was lodged with an ulterior motive–It deserves to be quashed.
