Code of Civil Procedure, 1908–Order 7, Rule 11–Rajasthan Tenancy Act, 1955–Sec. 207–Rejection of suit by allowing the application–Suit for cancellation of sale deeds, declaration of khatedari rights and permanent injunction–Perusal of the reliefs sought by the plaintiff shows that although the first relief is for cancellation of the sale deeds but the relief no. 3 specifically is for the declaration to the effect that the property in question being the ancestral and Joint Hindu Family Property, is the khatedari land of the parties and further that the plaintiffs are entitled for 1/5 share each in the said property–Only if the relief no. 3 is decided in favour of the plaintiffs, they would be entitled to get the sale deed cancelled–Main relief in the present suit is for declaration of khatedari rights–Jurisdiction lies with the Revenue Court–No interference is required in the impugned order.
