Penal Code, 1860–Secs. 302 & 341 [Corresponding Secs. 103 & 126(2) of BNS, 2023]–Acquittal–Justification–PW 10 is a natural witness and he gave a clear, consistent and cogent version of the incident that he saw the accused N, armed with knife, chasing and stabing the deceased on the back and, thereafter, inflicted a stab wound on the abdomen–Two defence witnesses admitted the fact of the incident–The recovery of blood-stained soil, bicycle, slippers and the conduct of the accused-respondent fleeing the scene of occurrence fortifies the version of the prosecution–The cumulative effect of the evidence leads to only one conclusion that the accused-respondent inflicted the fatal injuires upon the body of the deceased and is guilty of committing the offence–Held, he is convicted for the offences u/s. 302 & 341.
