Code of Criminal Procedure, 1973–Sec. 320 [Corresponding Sec. 359 of BNSS, 2023]–Penal Code, 1860–Sec. 429–Acquittal by compounding the offence–Compromise was attested by a person other than the owner of the property–Therefore, he was not a competent person–However, the incident took place in the year 1989 and the impugned order was passed in the year 1990–Case was exclusively triable by the Court of the Magistrate–It would be proper to exercise the inherent jurisdiction to bring quietus to the proceedings–Directed accordingly.
