Narcotic Drugs & Psychotropic Substances Act, 1985–Sec. 18–Acquittal from the charge of offence–Recovery of contraband in personal search–Testimony of PW 1 & 2 does not support the stand that the accused was informed about the right to be searched before a Gazetted Officer or a Magistrate–Independent witnesses PW 4 & 5 changed their version and stated that the search and seizure did not take place before them and they marked their thumb impression on being asked by the police–Testimony of police witnesses is also found inconsistent as regard to source information–Procedure prescribed in Sec. 50(1) was not complied–Held, acquittal was justified.
