Evidence Act, 1872–Secs. 26 & 27 [Corresponding Sec. 23(2), Proviso of BSA, 2023]–Confession was made by the accused to the police while he was made to sit inside the Panchayat building, which would be deemed as being in the police custody, therefore, the confession made by him to the police would be hit by Sec. 26 of the Act and in sequitur, it is not admissible as evidence.
