Arbitration & Conciliation Act, 1996–Sec. 34–Objections on arbitration award–Rejected–Earlier, the respondent filed the writ petition with the prayer that he may be allowed to operate the toll until the approved extended period–Though it was dismissed, the High Court observed that the Steering Group was not authorized to extend the concession period–Non-disclosure of dismissal of the writ petition in the arbitration proceedings tantamounts to grave misconduct on the part of the respondent–The decision of Arbitral Tribunal that the decision of Steering Group for extension of concession period is binding on the parties, is contrary to the judgment passed by the HIgh Court–Present award is clearly overlapping with the earlier award–Impugned award and the order passed by the Commercial Court are liable to be set aside.
