Penal Code, 1860–Secs. 302/149 & 307/149–Conviction High Court acquitted the six accuseds and confirmed the conviction of three persons u/ss. 302/34&307/34–Appreciation Prior enmity– Respondent accused B, K & G fired gun shots–Two persons were murdered and one sustained grievous injuries Presence of PW. 3, 4 & 6 was found doubtful, however, prosecution case against the three respondents well proved by the testimony of P.W. 2 and medical evidence P.W. 2 who sustained the gun injuries, stated about the specific role of accused A, S & B Role of other acquitted accused could not be established–Held, High Court was quite right in acquitting them and altering the conviction of respondents u/s. 302/34 & 307/34.
