Code of Civil Procedure, 1908–Sec. 100–Dismissal of second appeal without discussing or dealing with any issue arising in the case–Submissions urged by the appellant were also not dealt–Casual approach–Dispute as regard to title and possession of land–High Court was required to find out as to whether who is the owner of the land and who is in it’s possession–Impugned order set aside and matter remanded back for deciding afresh on merits.
