Rajasthan Tenancy Act, 1955–Secs. 88, 188 & 63(4)–Revenue suit regarding the declaration of ownership and possession–Decreed by RAA–Thereafter, the respondent-owner sought the NOC to install the petrol pump on the land–Forest Department refused to grant the NOC–Writ petition against–Allowed–Conclusion of RAA that the land of the respondent was different from the forest land–Once the Revenue Appellate Authority had recorded the categorical findings on the basis of documentary evidence and the department was the party of proceedings, and the land was recorded in pursuance to the order, and the judgment was not questioned, the Forest Department cannot be permitted to say that it was void against the department–Merely relying on the notification u/s. 4 of the Forest Act, the appellant cannot seek the reversal of findings–No case is made out for interference.
